Commercial pre-emption right in Paris

By Resolution No. 2024 DAE 26 dated February 6–9, 2024, the City of Paris established, as of August 7, 2024, a commercial pre-emption right in certain districts of Paris, concerning business assets, artisanal businesses, and commercial leases within the following area:

In the 7th arrondissement:

– Rue du Bac, numbers 2 to 26 and 1 to 25
– Rue de l’Université, numbers 2 to 42 and 1 to 25
– Rue des Saints-Pères, numbers 2 to 20
– The entire Rue de Verneuil
– The entire Rue Allent
– The entire Rue de Beaune
– Rue de Lille, numbers 2 to 50 and 1 to 37
– The entire Quai Voltaire

The entirety of the 5th arrondissement
And the entirety of the 6th arrondissement

This measure aims to maintain, and even strengthen, the density and diversity of cultural businesses present in these areas.

In practice, in the event of a sale of a commercial lease or of a business (commercial or artisanal), this pre-emption right must be included as a suspensive condition of the sale. The seller must submit to the city:

  • A prior declaration of sale by completing four copies of Form 13644*02

  • The commercial lease

From the date the declaration is received, the City Hall has a two-month response period. If no response is received within this period, the City is deemed to have waived its right of pre-emption.
